The power outages caused by last week’s Nemo blizzard, along with the damage and destruction from last October’s Superstorm Sandy (or any past or future weather event), left many companies (both providers and customers) scrambling to analyze their contracts for its provisions on matters like force majeure. Why should your company actually read the force majeure provision in each of its agreements? Many force majeure provisions require the customer to continue paying the provider – even during the force majeure!
