Now, here is where the confusion comes in. Based on the rule stated above, it would appear that if an employer with a fiscal year plan did NOT offer coverage to at least 33% of its workforce – or less than 25% of the employer’s workforce was actually covered under the plan – as of December 27, 2012, then it seems that this transition rule would NOT be available.
