Description

Anyone considering filing for bankruptcy naturally has many questions. Can filing bankruptcy help you with your specific debt problems? Will you have to give up any property during the process? What are the long-term consequences of bankruptcy? These are all important issues. I'm Ivan Trahan, an experienced California bankruptcy attorney based in Temecula and San Diego. I am dedicated to making myself personally accessible to clients so I can answer their questions about bankruptcy. Contact me today to schedule a free consultation and financial evaluation. Based on the information and documentation you provide at your free consultation and the discussion that follows, I will help you determine if bankruptcy is right for you and, if so, which type of bankruptcy you should file. The two major types are: -Chapter 13 bankruptcy The main difference between Chapter 7 and Chapter 13 is that in Chapter 7 you discharge most or all of your unsecured debt and either agree to continue to pay secured debts or return the secured property (think house or car) and in Chapter 13 you devise a three to five-year repayment plan where you pay all or part of your debt, the sum of which is decided based on a variety of factors. Deciding which chapter to file under requires as much careful consideration as does just deciding to file. In some cases, you pay less in a Chapter 13 repayment plan than you would in a Chapter 7, but not all bankruptcy lawyers have the experience they need to determine which is best for you. Only an experienced bankruptcy attorney is qualified to render this type of advice. Strategy and planning are crucial components to preparing for bankruptcy. With that in mind, we work hard at my firm to develop the best possible approach to solving your money problems. Bankruptcy is not for everyone. However, many companies offering alternatives to bankruptcy — such as debt settlement — do not have the same ethical responsibilities as attorneys and may not inform you of the dangers of their programs. If, however, you cannot file for bankruptcy, my office will help you negotiate your debts with your creditors.
