After review of our client’s health insurance plan language, Avrek Law firm determined that no subrogation rights existed because the plan language was ambiguous and did not specifically exclude the “made whole rule” as required by California Law. Our client had suffered serious injuries and incurred substantial medical bills. Accordingly our client was not “made whole” and repayment to the lien holding medical insurance carrier would have deprived our client of compensation for her pain and suffering.
