Below are some general points to consider and understand about lateral career moves in the legal market: -The best time for an associate to explore a new job at another firm is between his/her 2nd and 5th year of practice; however there are, occasionally, opportunities for candidates on either side of this range. -With few exceptions, the best time for an associate to explore an opportunity with a corporation is after his/her 6th year of employment. In many cases though, a corporation will not consider a candidate with less than 10 years of experience. -With very few exceptions, partners who wish to make a lateral move to another firm must have at least some portable business. -With some exceptions, large firms will only hire associates and partners from major firms (which may be other large firms, prestigious mid-size firms, and high quality boutique law firms). -In a poor economic climate, transactional attorneys will have a very tough time finding a job. Litigation attorneys are typically less affected by the health of the overall economy and may even benefit from a down market. However, during a severe economic downturn, where law firm clients become more cost conscious, litigation practices of firms of every size may also suffer, even if temporarily. Pending federal and state law and regulations may lend themselves to an uptick or downtick in litigation as well; finally lawsuit filings may be delayed, temporarily, thus decreasing litigation practices, when companies engage in a process of evaluating their damages from a breach of contract or other claim. -Contrary to popular belief, where you attended law school, and even the grades you received there (in the case of associates) may always be a factor in lateral hiring, depending upon the national (or even local) prestige of certain firms.
