Now, after weeks, months, or maybe even years of attempting to sell this property, the final step in the sale of the property, and more importantly, the receipt of your commission check, will be at the closing table, typically in the attorney's office. You are depending on the law firm and trusting that it is preparing the closing on the property in an efficient manner. The attorney's involvement in the sale of the property is two-fold. To begin with, the attorney is evaluating the title to the property. This takes place by reviewing the record room in the clerk's office of the superior court in the county in which the property is located. There, the research includes the status of title to the property including a determination of whether the property is encumbered by any loans, among other things. A title report is provided to either the borrower (if it is a cash closing), or the borrower's lender (if it is a lender funded closing) informing the respective party of the status of title of the property being sold. Secondly, the attorney is preparing the documents in preparation of the closing. These documents include the HUD statement, the affidavits, disclosure statements, deeds, and to the extent a lender is involved, final preparation of the lender's documents. We understand that you want to come to the closing table with no surprises, and it is our desire that all issues that do arise in preparation of the closing are communicated in an efficient manner, whether through the internet, or simply picking up the phone and placing a call.
