Description

Our client purchased a portfolio of unpaid receivables from a failed entity. They were provided with original promissory notes and limited documentation, but not much more. Records were in disarray or missing. With no witnesses from the failed entity, debtors refused to pay our client. We filed suit in the majority of the cases. Under the California Evidence Code, possession of an original note creates rebuttable presumptions that our client was the holder and owner of the note, and that the note was unpaid.

Our goal is to provide our clients with the most effective representation. Our experience has shown that one does not need an army of attorneys to be successful - all one needs is a smart and experienced collection and court room litigator with the right game plan and support. We pay special attention to case assessment, pre-litigation advice and candid analyses of the relative risks and rewards of litigation. In the event that litigation becomes necessary, we move quickly and effectively .

With over 25 solid years of experience in California collection and litigation, we know the answers to your collection questions.

What is the fee structure? Collection Lawyers generally charges a retainer to commence business and commercial litigation. If we are successful in recovery, there is also a contingent fee. Our clients generally advance costs. If a cross-action is filed, or if we're defending an existing action, we require a retainer and there are hourly fees. We aren't the cheapest, nor do we try to be. There is an old expression: "You get what you pay for". Collection Lawyers has been doing solid business and commercial litigation in the State of California for over 25 years. We know what we're doing.
