Under the California Evidence Code, possession of an original note creates rebuttable presumptions that our client was the holder and owner of the note, and that the note was unpaid.

What is the fee structure? Collection Lawyers generally charges a retainer to commence business and commercial litigation. If we are successful in recovery, there is also a contingent fee. Our clients generally advance costs. If a cross-action is filed, or if we're defending an existing action, we require a retainer and there are hourly fees.
