Our litigation practice has been active since the Firm was founded in 1991. We are active in the prosecution and defense of lawsuits in state and federal court, and are particularly experienced in patent and trademark litigation. Of late, more and more of our cases are patent infringement suits in the Eastern District of Texas, where we have become quite familiar with local rules and practices, and the tendencies of the Eastern District Federal Judges. We also represent clients in arbitration, mediation, and other alternative dispute resolution procedures.

The Firm provides services in structuring, drafting, and negotiating intellectual property and e-commerce transactions. Attorneys in the transaction practice assist clients with intellectual property assignments and licensing, technology transfer agreements, service agreements, software licensing, marketing and distribution arrangements, franchise agreements, non-disclosure/confidentiality agreements, technology development agreements, work made for hire agreements, and advertising and entertainment arrangements.

From many years of patent litigation, including cases tried long before Markman, we have adopted a no nonsense approach to preparing patent cases. Basic tenets of how we proceed in such cases are reduced to writing and followed. Other lawyers undoubtedly employ some of our practices but, in our Firm, they are bedrock principles that are used as a matter of course to keep us focused and efficient.

Our clients’ needs for sophisticated intellectual property services have enabled us to grow from nine attorneys to over forty-five professionals.

The Firm represented the owner of a patent on a method for creating a textured surface on pre-formed concrete walls. We were successful in obtaining a jury verdict that the defendants willfully infringed our client’s patent and that our client was entitled to lost profits, treble damages, attorneys’ fees and interest. The Firm successfully defended the judgment on appeal. The total award to our client was $7.5 million.
