IDEA Requirements for Use of PBS: Guidelines for Responsible Agencies (Journal of Positive Behavior Interventions, Volume 3, Number 1, Winter 2001, pages 11-18) The Individuals with Disabilities Education Act (IDEA) emphasizes the necessity of using state-of-the-art technology in special education (20 U.S.C. § 1400(c)(4)(5) (1999); see also 20 U.S.C. § 1400(b)(7) (1990)).

The Ninth Circuit just issued an excellent decision in a case for which COPAA filed an amicus brief. In K.M. v. Tustin Unified School District, the court held that a provision of FAPE under the IDEA does not necessarily satisfy the higher standard imposed by the ADA effective communication regulation.
