5. a. Notwithstanding the provisions of paragraphs 1, 2, 3 and 4, when the Projects Committee, based upon a recommendation of the Executive Director of the Authority, determines that the use of competitive bidding is either not practical or not in the best interest of the Authority (for example, where a design-build process is necessary or desirable in order to assure that the Authority deals with a single source provider for the design, installation, implementation and/or maintenance of an integrated system or installation), a contract may be entered into through competitive proposals.
