Description

In late January 2011, the Machinists Union called a strike against our client after the union’s membership rejected a recommended tentative agreement. After a second tentative agreement also was rejected, our firm provided advice to the company on how to weather the strike, including the hiring of permanent replacements for the approximately 100 employees on strike.

Texas is the only state that allows employers to completely opt out of, or “nonsubscribe” from, the traditional workers’ compensation system. Nonsubscribers can avoid high premiums and a rigid state-mandated bureaucracy and instead implement self-funded occupational injury benefits plans that are better tailored to their industry. Many nonsubscribers have realized significant savings compared to the traditional workers’ compensation system. The tradeoff for nonsubscribers, however, is that their injured employees may sue to recover damages based on the employers’ alleged negligence.

Fisher & Phillips attorneys have decades of experience practicing before the National Labor Relations Board, the National Mediation Board, and the Federal Mediation and Conciliation Service. We also have gone head-to-head with some of the toughest and most politically-savvy unions in the nation.

Fisher & Phillips has one of the largest labor and employment law practices in California with more than 50 attorneys in four offices: Irvine, Los Angeles, San Diego and San Francisco. These include veteran jury trial lawyers, attorneys with extensive experience in defending class actions, attorneys well-versed in the unique features of California wage and hour law, and attorneys experienced in designing alternative dispute resolution methods that can keep employers out of California courts.

We also regularly sponsor and participate in a number of diversity initiatives in our communities and host in-office events, such as our New Attorney Survival Skills Program, for law students and young attorneys from diverse backgrounds. These events are designed to help young attorneys learn how to succeed as associates. Additionally we provide scholarships and participate in conferences devoted to diversity and inclusiveness issues.
