At least one Minnesota judicial decision has upheld the statutory prohibition on the professional advisor or attorney representing the injured party / proposed transferor (hereinafter the "Proposed Transferor"), from having a compensation arrangement which is contingent on the proposed transfer being approved by the court. Therefore, the attorney for the Proposed Transferor cannot represent the Proposed Transferor under a payment plan which will only compensate the attorney if the transaction is approved by the court.
