Prop 65 actions can be brought by the California Attorney General or other public or private entities, or anyone who chooses to bring suit “in the public interest”. This means at any point a company can be involved in a lawsuit resulting in the warning being placed or come to a settlement. A lot of companies are also putting warnings up as new chemicals become a part of the list. There are also some exceptions to the proposition. If your company has 10 or less employees, you are exempt from having to place the warning, regardless of the levels of chemicals o Prescription drugs are also exempt from providing a prop 65 warning.
