Company News On May 17th of this year the U.S. Supreme Court decided an important bankruptcy case concerning interest rated used in Chapter 13 bankruptcy cases for secured claims. the case was Till v. SCS Credit Corp. and it was decided by a vote of 4+1 to 4, with Justice Thomas' concurrence in the opinion of a plurality carrying the day. Specifically at issue in Till was the question what interest rate should be accorded a secured creditor's claim under a Chapter 13 Plan. The decision came out more in favor of debtors than creditors. As a result, in all new Chapter 13 cases (and probably in Chapter 11's as well) we will be seeing interest rates proposed on secured claims at rates ranging from "prime" to "prime plus 1 to 3%."
