United States Supreme Court amicus brief on behalf of twenty leading manufacturers in support of a petition for certiorari, arguing that punitive damages should not be awarded against a manufacturer for conduct that complies with regulatory standards and industry custom.

The appeal involved important issues of corporate law, such as whether real party defendants have standing to assert procedural defenses that normally would be asserted by the corporation, including the failure to present a timely pre-suit demand to the corporation. But the Court of Appeal affirmed the defense judgment on the alternate ground that the causes of action were unsupported by the facts.
