Steve had clients with disability claims who also needed help with workers’ compensation issues. During the appeal stage, the firm strives to resolve the benefit claim in the employee’s favor without the need for litigation. It is critical to have the assistance of an attorney familiar with the ins and outs of ERISA at this stage, because all evidence supporting the claim must be presented to the Plan Administrator before its final determination of the claim. Generally, the employee is barred from presenting any new evidence in support of a claim once the Plan Administrator (often an insurance company) has rendered its final decision. The employee is only permitted to argue to a federal court that the Plan Administrator arbitrarily considered or ignored the evidence presented to it, not that there is additional evidence to support the claim. Steve coordinates with health care providers and other experts to provide the Plan Administrator with all evidence in support of the disability, life insurance, or severance claim . If the Plan Administrator does not grant the benefit, Steve has over twenty-five years of experience in prosecuting claims for benefits before federal district courts, even with the very stringent standard that courts apply to such claims.

Tom Sennett has been handling workers’ compensation cases (and other matters) for over 25 years. When he first began practicing, most of his work was on behalf of employers and insurance companies, so he knows how they think. He has special insight on how insurance companies approach workers’ compensation claims, the tactics they use to try to defeat valid claims , and the methods they use to intimidate injured workers. He now handles cases on behalf of injured workers, and uses his inside knowledge and experience to win cases for his workers’ compensation clients.
