All of the healthcare services that a patient receives are delivered by their selected provider(s), and are subject to all applicable law and regulation, which includes a federal law known as HIPAA - the Health Insurance Portability and Accountability Act of 1996. As part of our commitment to fully comply with HIPAA, some of the services that we may deliver to patients and/or their providers are performed under a Business Associate contract. A Business Associate contract is established as a requirement by HIPAA and is between us and a patient's provider, assuring that the provisions of HIPAA are followed in how we perform our services. Patients who do not wish their Patient's Continuity Record to be processed in our system can always opt out either by not signing up in the first place or by canceling their participation at any time. Patients may also receive services from a health care provider and choose to not disclose the existence of their Patient's Continuity Record to that provider. Such a decision may have adverse consequences that patient's health outcomes, but does remain their choice. Patients who do choose to have their Patient's Continuity Record communicated to their providers may also choose to opt in for their information to be searchable from any Emergency Department where they may be treated, regardless of any applicable law or regulation. Patients who do so must also agree to release us from any claims regarding disclosure of the existence of their information. This particular opt-in decision pertains to possible scenarios that arise when a patient is not fully conscious and does not have complete identification on hand. Emergency Department personnel may be able to access a Patient's Continuity Record from partial information on hand, and finding the Patient's Continuity Record may result in a better health outcome. Patients must first consent to make their information searchable from any Emergency Department that may be treating them.
