Further, income and profits from the business may also be considered marital property. Whether this is the situation or a family business is started during marriage, the value of the business must be determined and the marital and separate property percentages of the business evaluated. Many divorces involving a family business or professional practice require the use of one or more forensic accountants to analyze the assets, revenue stream, liabilities, inventory and other aspects of the business as part of the business valuation process. Mr. Iken is the managing and founding member of our firm. He began practice as a divorce attorney in New Port Richey and currently splits his schedule with our Tampa office. Allison Belcher has been with the Law Firm of Ayo and Iken for many years. Besides serving as a public defender and probation officer, Ms. Belcher has personally conducted hundreds of divorce cases in the New Port Richey courthouse. Ms. Belcher is an experienced divorce attorney with extensive knowledge of the New Port Richey area. She appears frequently at the Pasco courthouse, is known to local attorneys and judges, and is well respected in the area.

A common question in divorce or custody cases is whether Florida would be the correct state to file the case or whether jurisdiction rules require a different state. There are some established rules and procedures for jurisdictional questions. One of the more common rules is called the UCCJEA – Uniform Child Custody Jurisdiction and Enforcement Act. The US Constitution and Federal Court decisions have established other rules. A very common principle was established by a really old case – International Shoe (yes, that case affects divorce and custody).
