Mike K. Kim is an Illinois attorney, licensed to practice law in Illinois and the federal courts of the Northern and Southern Districts of Illinois. Since 2001, Mr. Kim has successfully obtained judgments and settlements for consumers across Illinois, from Jo Daviess County in Galena, Illinois, to St. Clair County in Belleville, in two (2) of the nationâ??s largest multi-state lemon law firms. Since departing from these law firms, Mr. Kim and his staff continue to advocate and fight on behalf consumers across Illinois against manufacturers of vehicles and other consumer products, always providing free representation focusing on Illinois law and Illinois clients with their â??lemons.â? Throughout his time practicing lemon law and now through the Law Office of Mike K. Kim, Mr. Kim has obtained vehicle repurchases, lease cancellations, vehicle replacements, and thousands of dollars in cash settlements from car manufacturers, with the majority of these cases resolved prior to the filing of a lawsuit.

Communication with clients and client advocacy are always top goals and a part of our mission to serve consumers with their defective vehicles. Individual attention is given to each case, as not all cases are the same. Therefore we are not striving to be the biggest multi-state firm, but strive to provide the best quality attorney representation and individual attorney attention to each case. All representation and counseling is provided without â??legaleseâ? or difficult to understand legal terms, explained with straight-forward, practical, no-nonsense advocacy and through simple explanation of all the laws, while using laws that provide for payment of attorneysâ?? fees by the manufacturer or warrantor. Thus the consumer never pays for any attorneysâ?? fees for experienced â??lemonâ? law attorney representation!.

(a) If after a reasonable number of attempts the seller is unable to conform the new vehicle to any of its applicable express warranties, the manufacturer shall either provide the consumer with a new vehicle of like model line, if available, or otherwise a comparable motor vehicle as a replacement, or accept the return of the vehicle from the consumer and refund to the consumer the full purchase price or lease cost of the new vehicle, including all collateral charges, less a reasonable allowance for consumer use of the vehicle. For purposes of this Section, "collateral charges" does not include taxes paid by the purchaser on the initial purchase of the new vehicle. The retailer who initially sold the vehicle may file a claim for credit for taxes paid pursuant to the terms of Sections 6, 6a, 6b, and 6c of the Retailers' Occupation Tax Act (35 ILCS 120/6, 35 ILCS 120/6, 35 ILCS 120/6a, 35 ILCS 120/6b and 35 ILCS 120/6c).

(h) In no event shall the presumption herein provided apply against a manufacturer, his agent, distributor or dealer unless the manufacturer has received prior direct written notification from or on behalf of the consumer, and has an opportunity to correct the alleged defect.
