All practitioners should be cautioned to NEVER use a plan administrator’s sample without ensuring the addition items identified below are incorporated therein. The reason for this is that there are only 11 required items which must be included in a QDRO to be considered qualified under the Internal Revenue Code, but to properly represent the interest of your client so that benefits are not subject to loss, we recommend an additional 30-32 provisions, depending on the type of plan. Plan administrators will readily give you a free sample and if you use it, they will quickly approve it. As you read through this section, you will notice the areas which could expose your client to loss and your practice to liabilities.
