Are “electronic discovery” and “computer forensics” one and the same thing? Many vendors and attorneys use the terms interchangeably, but there is a difference in the answers that each of the processes provide in the discovery process. In some cases, only electronic discovery techniques are necessary to produce or review massive amounts of electronic files from a computer hard drive. In such cases, no information other than the contents of the files and the metadata associated with each file are crucial to the prosecution or defense of the case. In other cases, a complete computer forensic examination of the computer hard drive may be warranted to go beyond just providing electronic documents, but also rendering information about the data on the hard drive that is hidden, encoded, or inferred from other data that has been discovered. The latter is the purview of the field of computer forensics. The phrase “electronic discovery” has typically been used to identify the process of collecting, processing, and producing electronic documents, e-mail messages, database records, etc.
