Description
In this document "We" means I.E.C.C., "You" means a customer. If you resell our service to third parties, you agree that these terms are binding on those parties and that you will notify them of these terms. We will provide access to the Internet for your computer servers that are physically located in our premises. Although we will make reasonable efforts to provide continuous service, we do not guarantee that service will be uninterrupted, due either to failures of our hardware or software, or failures by our providers, nor do we guarantee that any particular part of the Internet will be reachable at any time. We may use internally maintained filters as well as third party filtering lists such as the MAPS RBL to limit the flow of undesirable material into our network. We are responsible for the maintenance of hardware and software that we own. You are responsible for the maintenance of hardware and software that you own. You agree to make reasonable efforts to make your software secure against access by unauthorized persons and mechanical attacks such as software viruses and worms. We will not in general make changes to your hardware or software without your permission, although we reserve the right to do so in cases of emergency such as an active software virus or worm running on your computer. When we schedule service interruptions for maintenance, we will attempt to advise you in advance and to schedule them at mutually convenient times. If we reasonably have a basis to suspect that you are engaging or have engaged in any of the prohibited activities below, we may partially or completely suspend your service while we investigate. We will attempt to advise you as soon as practical if we suspend or intend to suspend your service. If we determine that you have engaged in prohibited activities, we may suspend or cancel your service at our option. If we suspend or cancel your service, our liability is limited to a refund of any amounts already paid for service during the periods of suspension or cancellation. Since your connection to the Internet is provided via our equipment, we can partially or completely suspend your service without making any changes to your hardware or software. PROHIBITED ACTIVITIES - Attempts to interfere with service to any user, host, or network. This includes "denial of service" attacks, "flooding" of networks, deliberate attempts to overload a service and attempts to "crash" a host. - Sending email to any person whom you could reasonably anticipate not to wish to receive it. If a recipient asks to stop receiving email, you must not send that person any further email. - Forwarding or otherwise propagating chain letters and pyramid schemes, whether or not the recipient wishes to receive such mailings. - Forging of header information in mail messages. - Promoting, marketing or otherwise directing traffic (directly or indirectly) to a web site hosted by us through the use of UBE. - MAILING LISTS You may maintain and e-mail mailing lists of people who have requested to be on your list(s). In case of complaints, we may require you to show documentation that recipients asked to be placed on your list.
