Plaintiff/Class Counsel Emmons, et al. v. US WEST Communications, Incorporated RP lawyers brought a series of state-wide consumer fraud class actions against US WEST (now Qwest) in Arizona, Colorado, Minnesota, New Mexico, Oregon, Utah and Washington over delayed installation of residential and business telephone lines. The hard-fought "held order" litigation culminated in the creation of a $120 million settlement fund for the seven cases, in which class members received dollar-for-dollar credits or outright cash payments for the financial losses and inconvenience they suffered as a result of having to wait for phone service installation. Bublitz, et al. v. DuPont When DuPont de Nemours & Company purchased Pioneer Seed Company some current and former Pioneer employees were denied the beneficial retirement and employment severance packages they had been promised. RP lawyers brought an ERISA class action in federal court in Iowa on behalf of the Pioneer employees. Shortly after the class was certified, DuPont approached the firm's clients with attractive individual settlement offers and the case was resolved favorably. Carlisle, et al. v. Pardee Homes Experienced construction defect lawyers in Nevada turned to the lawyers at RP to assist them with the representation and trial of a certified class of Las Vegas homeowners seeking damages caused by faulty construction of their homes. Just before trial was set to begin, the matter was settled favorably for the class members. Colorado Lawyers Committee Through the firm's extensive involvement with the Colorado Lawyer's Committee (CLC) [web link], RP lawyers have been involved in several pro bono class action cases on behalf of disadvantaged Colorado residents: • RP lawyers spearheaded the Homeless ID Task Force which was established to help homeless individuals unable to secure housing, employment and other services due to a systemic inability to obtain government-issued identification cards. In December 2006, Task Force volunteers successfully enjoined the Colorado Department of Revenue to adopt regulations regarding the issuance of ID cards and to establish procedures to provide due process to individuals who are denied IDs. • RP lawyers have been extensively involved in the CLC's Mental Health Task Force that, among other significant issues, advocated to assure that individuals with mental illness leaving the criminal justice system are able to access benefits and medical care. • RP lawyers were instrumental in a CLC task force that successfully argued for certification of a class of Colorado welfare recipients and helped to win a significant victory for the welfare recipients at trial, securing nearly $1 million in wrongly withheld benefits. Defense Garcia v. Medved Chevrolet, Incorporated RP represents the Medved automobile dealerships in defense of a class action lawsuit filed in Jefferson County District Court alleging violations of the Colorado Consumer Protection Act (CCPA). Plaintiff alleges the dealerships' addition of aftermarket products to new vehicles such as pinstripes and protective clear bras violates the CCPA.
