During the last 16 years, Mr. Turner's primary area of practice has been in the field of eminent domain litigation. The practice of Mr. Turner and his firm consists primarily of defending landowners and business owners against various governmental agencies in eminent domain actions. Mr. Turner holds the highest rating from Martindale-Hubbell. After graduating from Hastings College of the Law in 1989, Mr. Turner went to work as a deputy district attorney for the County of Marin for 2 years. As a deputy district attorney, Mr. Turner tried over 30 jury trials. Mr. Turner then became an associate with the law firm of Ropers, Majeski, Kohn, Bentley, Wagner & Kane in Redwood City where he practiced for 2 years. Three Rivers Levee Improvement Authority (TRLIA) v. Turner & Turner client (Yuba County) Represented large pear orchard company in condemnation action brought by TRLIA to acquire 822 acres of pear, cherry and persimmon orchards for its levee improvement project near Marysville. The remaining 158 acres was improved with orchards and approximately 200,000 sq. ft. of buildings including offices, cold storage facilities and packing houses. TRLIA exchanged a list of 15 expert witnesses. Its appraiser's opinion of just compensation was $10,029,500.00. Compensation obtained for Turner & Turner client was $17,500,000.00. Caltrans v. Turner & Turner client (San Mateo County) Represented owner of 290 acre property in condemnation action brought by Caltrans for construction of its Devil's Slide Project on State Route 1. Caltrans acquired various property interests (e.g. fee, tunnel easement, aerial easement, conservation easements, permanent access easements and temporary construction easements) for construction of its tunnel and bridge. Significant issues in this case included highest and best use and severance damages relating to the conservation easements and the 125' high Project bridge spanning a portion of the property. This case involved extensive discovery including over 25 depositions. Caltrans originally offered $454,000.00. Compensation obtained for Turner & Turner client was $3,047,000.00. Caltrans v. Turner & Turner client (San Mateo County) Represented property owner in action brought by Caltrans to acquire property which became inaccessible as a result of Caltrans' Devil's Slide Project on State Route 1. Caltrans' original offer was $300,000.00. Compensation obtained for Turner & Turner client was $650,000.00. City of San Jose v. Turner & Turner client (Santa Clara County) Represented property owner/developer in an action brought by the City of San Jose to acquire property for a community center. At the time of its acquisition the property was entitled for development of a retail center on Bascom Avenue. One of the issues was the amount of added value resulting from those entitlements. The City originally offered $5,683,000.00. Compensation obtained for Turner & Turner client was $7,700,000.00.
