After graduating from Indiana University School of Nursing—Indianapolis in 1997, Kelly began her professional career working as a registered nurse for Wishard Health Services. Kelly has nursing experience in several areas including pediatrics, obstetrics, gynecology and home health care. Kelly worked as a registered nurse for more than seven years before going back to school and earning her J.D. from Indiana University – Indianapolis in 2005.

On paper, this does not sound so bad. However, unlike a judge and jury, the arbiter is usually paid by the company forcing arbitration. Because the company decides who will be the arbiter, it has the ability to hire someone that is more likely to look at its arguments favorably. Also, because it is the company that does all the hiring, a truly neutral arbiter can be blacklisted if he or she does not reach a decision that the company believes is reasonable.
