A pure captive insurance company is an insurance company created by the owners of an operating business to provide supplemental property and casualty insurance to such operating business. The shares of the captive insurance company can be owned by owners of the operating business or an irrevocable trust for the benefit of such owner’s heirs. For many years the IRS argued that premiums paid into a captive insurance company were not deductible due to the related ownership of the insured and insurer (referred to as the “economic family doctrine”).

The civil litigation department has experienced rapid growth over the last several years. The trial lawyers in this department have developed outstanding reputations for obtaining excellent results for our clients, as well as providing exceptional responsiveness and service to each client regardless of the size or nature of the case. In 2005, the population estimate given by the U.S. Census Bureau was 268,080. Lexington is known as the "Horse Capital of the World," since it is home to the Kentucky Horse Park, Keeneland race course and the Red Mile race course. The area is noted for its beautiful fertile soil; bluegrass (known as poa pratensis) is plentiful in the limestone rich soils.
